Online Library Terms for usage

Access to the Institute's Online Library is available for its members and students (the  "Authorized Users"). Such access requires the Authorized User to verify his/her identity by logging-in using his/her ID and password.

 

In logging-in and gaining access to the Online Library, Authorized Users agree to the following terms and conditions for usage of the Online Library:

 

1.

The entire contents or database of the Online Library is protected by the relevant copyright laws as stipulated by the resource provider, and Authorized Users agree to comply with all such relevant copyright laws.


    2.

    The use of following resources is further governed by the following specific terms and conditions, of which the Authorized Users also agree to abide by the same.


      3.

      For resources or materials provided by LexisNexis, the following terms apply:-


        (a)

        The right to obtain a printout of materials is limited to a printout of a reasonable portion of the materials obtained using the printing commands of the online services or the Authorized User's web browser software and the creation of a single printout of a reasonable portion of the materials downloaded via downloading commands of the online services or web browser software (collectively, "Authorized LN Printouts");

         

        (b)

        The right to retrieve and store machine-readable copies of materials is limited to the retrieval of a single copy of a reasonable portion of the materials included in any individual file of the online services using the downloading commands of the online services or the Authorized User's web browser software and storage of that copy in machine readable form for no more than 90 days primarily for one person's exclusive use. Insubstantial electronic copies of the materials may be stored beyond the time restriction referred to in this clause where (i) the materials have been incorporated into advice provided to a specific client in respect of a specific matter; and/or (ii) the material is required to be kept for some legal, regulatory or evidential requirement.  This clause is subject to the overriding obligation that no independently searchable database of the materials is created;

         

        (c)

        To the extent expressly permitted by applicable copyright law, copies of Authorized LN Printouts may be made and Authorized LN Printouts and copies may be distributed;

         

        (d)

        Except as provided above, Authorized Users are otherwise prohibited from downloading, storing, reproducing, transmitting, displaying, printing, copying, distributing, or using materials retrieved from the online services. Authorized Users may not print or download materials without using the printing or downloading commands of the online services or the web browser software. All access to and use of the online services via mechanical, programmatic, robotic, scripted or any other automated means not provided as part of the online services is strictly prohibited. Use of the online services is permitted only via manually conducted, discrete, individual search and retrieval activities;

         

        (e)

        Copyright notice or other notices contained in materials retrieved from the online services may not be removed or obscured.

         

        4.

        For resources or materials provided by ProQuest, the following terms apply:-


          (a)

          Authorized Users are permitted to display and use reasonable portions of information contained in the service for educational or research purposes, including illustration, explanation, example, comment, criticism, teaching, or analysis;

           

          (b)

          Authorized Users may download or create printouts of a reasonable portion of articles or other works (i) for its own internal or personal use allowed under the doctrines of "fair use" and "fair dealing"; (ii) when required by law for use in legal proceedings; or (iii) to furnish such information to a third party for the purpose of, or in anticipation of, regulatory approval or purpose provided that the recipient are advised that the copies are confidential and not for redistribution;

           

          (c)

          All downloading, printing and/or electronic storage of materials retrieved must be retrieved directly from the on-line system for each and every print or digital copy;

           

          (d)

          Provided no features or functionality of the service is circumvented, Authorized Users may include durable links to articles or other works (or portions thereof) in electronic reserve systems, online course packs and/or intranet sites so long as access to such materials are limited to Authorized Users;

           

          (e)

          Authorized Users may use the materials consistent with the doctrines of "fair use" or "fair dealing" as defined under the laws of the United States or England, respectively.

           

          5.

          For resources or materials provided by ebrary, the following terms apply:-


            (a)

            The usage is a non-exclusive, non-transferable, revocable, limited license to access and use this site for noncommercial research purposes;

             

            (b)

            Limited noncommercial use of small portions of materials to the extent permitted under United States law pursuant to the Doctrine of Fair Use is allowed;

             

            (c)

            The materials may be electronically displayed to one person at a time. For Authorized Users affiliated with an educational institution, the materials may be displayed to multiple individuals during class time for teaching and demonstration purposes to the extent permitted under United States law pursuant to the exemption of certain performances and displays;

             

            (d)

            Authorized Users may copy and print small portions of the materials using the copy and print features available on this site to the extent permitted under United States law pursuant to the Doctrine of Fair Use;

             

            (e)

            Any other use requires written permission from the copyright holder;

             

            (f)

            Materials may not be redistributed in any manner, including by posting any materials on the Internet, distributing them via e-mail, on paper, or otherwise, except as expressly permitted above;

             

            (g)

            Authorized Users must interact with the site manually, using a web browser and one of the ebrary readers, and may not use other computer programs or any other automated method of accessing or obtaining materials or information from this site, or circumvent limitations on the number of pages allowed to display, copy, or print.

             

            6.

            For resources or materials provided by Wolters Kluwer (CCH), the following terms apply:-


              (a)

              Authorized Users are permitted to retrieve, display, search, download, print and store individual articles for scholarly research, educational and personal use;

               

              (b)

              Authorized Users may copy and store single copies of a reasonable number of individual articles. However, copying and storing entire issues is not permitted;

               

              (c)

              Authorized Users may not modify, adapt, manipulate, transform, translate or create derivative works based on any materials provided, or otherwise use any such materials in a manner that would infringe the copyright therein;

               

              (d)

              Any copyright or other notices or disclaimers included in the material may not be removed, obscured or modified. Accompanying screen displays may not be removed, obscured or modified.

               

              7.

              The Institute will hold the Authorized User fully liable on an indemnity basis for any loss, damage, liabilities, and costs that it may suffer as a result of any breach of the above terms or any other copyright infringement by the Authorized User.
